Health Care Language Assistance Translation
For many Health Plan members language is a barrier to health care. California’s SB853 is a progressive step toward overcoming this barrier. SB853 requires California health plans to set up a system to provide services, materials, and information in a language that members speak and understand. With the goal of establishing programs that provide language assistance to all HMO members, DMHC has adopted regulations for health care plans and providers.
Under the DMHC’s jurisdiction, the regulations will require each of the 100 full-service and specialty health care plans (e.g. dental, vision) to develop and implement its own Language Assistance Program. In addition to language assistance, health plans will be required to translate documents including:
• Standard letters and notices of insurance eligibility and membership requirements
• Notices of any denial, reduction, modification, or termination of services and benefits
• Notices of the right to file grievances or appeals
The regulations also apply to health plans’ delegated providers, ensuring plan members receive services in a language they understand, regardless of who is the provider.
